What Are the Penalties for Drug Possession in California?

Blog

In California, there are two categories for crimes involving drug possession – simple possession and possession with intent to sell. Moreover, depending on the drugs involved in your case and how they are classified, the penalties you face may vary in severity. Continue reading to find out about the penalties you may face for drug possession.

POSSESSION OF A CONTROLLED SUBSTANCE IN CALIFORNIA

California defines controlled substances as regulated drugs that were placed on a schedule by the state. Some controlled substances, such as cocaine, meth, or heroin, are always illegal. Others, such as prescription painkillers, are not. However, they all fall under the California Health & Safety Code, which defines six schedules of controlled substances.

Simple possession cases are known as a “wobbler” offense in California, which means that, depending on the facts of your case, the prosecution may charge you with either a felony or a misdemeanor.

If convicted of the felony form, without enhancement, the penalties you face may include:

  • Up to 3 years in state prison
  • A fine of up to $10,000
  • Both imprisonment and a fine

If you are charged with possession for sale of a controlled substance and you are convicted without enhancement, you may face similar penalties. However, if you transport a controlled substance for sale, you may face up to 5 years in prison.

Below are some of the controlled substances regulated by the government under the United States Controlled Substances Act:

  • Cocaine
  • LSD
  • Heroin
  • Peyote

Additionally, the law also applies to prescription drugs, such as codeine, hydrocodone, ketamine, and oxycodone. If you are facing possession charges, do not resign yourself to defeat. It is crucial to retain skilled legal counsel as soon as possible to protect your rights and future.
